saparapi.id – Action Forum Caring for Local Workers (FAP-TEKAL) City of Dumai held a public presentation at the gate of PT Dumai Paricipta Abadi (DPA) on Jalan Bahtera, Dumai City, Tuesday (23/05/2023).
The peaceful demonstration was a concern for local workers who were also members of FAP-TEKAL who had been laid off urgently by the company because of accusations of extortion.
The company’s accusations against the workers are considered baseless and not in accordance with the Labor Law.
“If indeed workers commit extortion, which according to the law is clearly a crime, we invite the company to report it to the police. As long as there is no permanent legal decision, the company cannot make urgent layoffs,” said the head of FAP-Tekal, Ismunandar in his speech, quoted from Harian.co.
Ismunandar also said that urgent layoffs also used rules namely the parent company PT DPA, while PT DPA itself is a company with an independent legal entity.
Ismunandar explained, PT DPA, which operates on the coast of the City of Dumai, is conducting logistics business with Bulking Stations. According to the OSS application data, PT DPA is one of 7 subsidiaries of PT Mahkota Group Tbk.
“This means that the two companies are different legal entities, PT DPA and PT Mahkota Group Tbk and have violated the provisions of Permenakertrans No. 28 of 2014, concerning procedures for making and ratifying company regulations and making and registering collective labor agreements,” explained Ismunandar.
“We have also found that PT DPA has never reported the structure of the wage scale, the mandatory reporting of laborers, and the company’s obligations to the Manpower Office of the City of Dumai. We also find that companies are flouting the Regulation of the Minister of Manpower and Transmigration No. 39 of 2016 concerning Manpower Placement,” he added.
Ismunandar will also continue the action in the same place, to urge the management of PT DPA to show the urgent layoff regulations that were applied to Faisal and not urgent layoffs according to the rules of the Mahkota Group Tbk.
Meanwhile, a PT DPA representative known as Zainal confirmed that Faisal’s urgent layoffs used PT Mahkota Group Tbk regulations with the reason being derivative because PT DPA is a subsidiary of the company.
